Article 1 Your Rights

You may use, duplicate, or re-distribute the Software to a third party under the conditions set forth herein. If you violate any of the conditions contained in this document, Hitachi-Solutions may terminate all license agreements existing between you and Hitachi-Solutions. In such an event, you must immediately dispose of the Software and any and all copies.

(1)	You may not use, duplicate, or re-distribute the Software except as permitted herein. You may not perform any action, including modification and adaptation, that violates copyright laws and may duplicate and re-distribute the Software only as permitted herein.
(2)	You may not reverse-compile, reverse-assemble, or otherwise reverse-engineer the Software.
(3)	You may use the Software only for legitimate purposes, and may duplicate the Software for backup only to the extent necessary to use the Software. You may also re-distribute the Software to a third party and may duplicate the Software for re-distribution only under the following conditions:

       (a) The Software is distributed free of charge.
       (b) The Software is used for non-commercial purposes.
       (c) The Software is distributed together with the License Agreement.

(4)	If you dispose of storage media on which the Software is furnished, you must delete the stored Software from those media before disposal.

Article 2 No Warranty Provided

Hitachi-Solutions makes no warranty whatsoever, either express or implied, with respect to the Software or technical support (if provided), including warranties covered in law, warranty of merchantability, and warranty of fitness for a particular purpose. Unless otherwise stated, Hitachi-Solutions does not provide technical support for the Software.

Article 3 Liability Limitation

Neither Hitachi-Solutions nor the developer of the Software shall be liable for compensation for any damage suffered by you through the use of the Software.

Article 4 Export Restrictions

The Software provided by Hitachi-Solutions to you based on this License Agreement is a designated program as stipulated in Article 9, Paragraph 2, Item 14-2 of the Japanese "Ministerial Ordinance concerning Invisible Trade". If you take any of the following actions, either directly or indirectly, you must follow all procedures required by the Foreign Exchange and Foreign Trade Control Law of Japan and the export control regulations of any foreign nations, including the U.S. Export Administration
Regulations:

       (a) You export the Software.
       (b) You take the Software out of the country.
       (c) You provide the Software to anyone who is not a resident of the country.

The Software is also subject to the U.S. Export Administration Regulations. Re-export of the Software might require approval from the U.S. government. If you intend to re-export the Software, you must obtain a prior written license from the U.S. Bureau of Industry and Security (BIS) and/or the Office of Foreign Assets Control of the U.S. Treasury Department (OFAC) before re-exporting the Software to any of the countries embargoed by the U.S. (as of January 2010, Iran, Cuba, Syria, Sudan, and North Korea), organizations engaged in the spread of biological and chemical weapons, nuclear weapons, and missiles which are subject to export restrictions, or individuals or organizations contained in the list of U.S. export restrictions (Denied Persons List, etc.). You must also obtain a U.S. export license when the Software has been incorporated in any other product.
The Software is also subject to the Chinese Regulations for the Administration of Commercial Encryption, which basically ban companies and individuals from using any non-Chinese encryption products in China (Article 14). If you intend to use the Software in China, you must obtain an import license and usage license from the Chinese government. Although the French government has encryption control regulations, the Software can be used in France because Hitachi-Solutions has obtained permission from the government for its use in France. The regulations of the Russian government ban the Software from being brought into or used in Russia without authorization, whether the Software is for personal use or not.

Article 5 Court of Competent Jurisdiction

Only the district court with jurisdiction over the premises of the Hitachi-Solutions headquarters shall have jurisdiction over any disputes
arising with respect to the License Agreement.
